Virginia Ignition Interlock Program

Since 1972, the Virginia Alcohol Safety Action Program (VASAP) and the 24 local programs known as ASAPs have become vital self-supporting entities that work within the framework of VA DUI laws to develop “alcohol countermeasure activities.” The five components adopted by the programs are intended to improve highway safety:

  1. Enforcement: VASAP works with law enforcement by enhancing their traffic division with the addition of state-of-the-art equipment and training in the detection and apprehension of DUI offenders.
  2. Adjudication: VASAP works with the courts and prosecutors to efficiently process those convicted of a DUI, and those referred to an ASAP for probation. In collaboration with the courts, VASAP has also developed proper revocation procedures when a DUI offender violates probation.
  3. Case Management and Offender Intervention: A case manager is assigned to each offender. The case manager determines which educational and treatment services are needed and supervises the case until all probationary requirements are satisfied.
  4. Public Information: VASAP is proactive with providing public information about the costs and dangers of drinking and driving.
  5. Evaluation and Certification: VASAP is evaluated and certified by The Commission on VASAP to ensure that the programs are effectively and efficiently serving the community.

The VASAP and the local ASAPs are funded independently of tax dollars. According to Virginia DUI laws, each DUI offender on probation is required to pay a “minimum participation fee.” The program also receives periodic highway safety grant money.

Virginia Ignition Interlock Device Laws

Virginia ignition interlock device laws require any driver convicted of a DUI to install an interlock device on any vehicle owned or operated by said driver. Further, that driver is prohibited from driving any vehicle not equipped with an ignition interlock.

When stopped for suspicion of DUI in Virginia, a driver who registers a blood alcohol content (BAC) of 0.08% or higher, or refuses to take the breathalyzer test is subject to an automatic license suspension of between 60 days and one year.

A person convicted of drunk driving may be subject to the following Virginia DUI laws, which vary depending on the driver’s previous record:

  • 1st Offense: With a first offense, a driver is subject to a $250 fine, a minimum of five days in jail, and a license suspension of up to one year. Installation of an interlock device for a minimum of six months.
  • 2nd Offense: The second offense increases the penalties to a $500 minimum fine, and jail time is at least 20 days and can extend up to one year. The driver’s license is suspended for three years after which time an ignition interlock device will be installed according to the determination of the judge in the DUI Virginia case.
  • 3rd Offense: With a third offense, one convicted of a DUI in Virginia can expect the penalties and fees to increase substantially. A minimum of a $1,000 fine is imposed as well as a minimum of a six-month jail sentence. The license is suspended indefinitely and will be adjudicated by the court at the time of the VA DUI conviction.
