Ignition Interlock DUI Laws in Missouri

Missouri law requires any person guilty of a second or subsequent intoxication-related traffic offense to install an ignition interlock device on any vehicle they operate. Drivers must do so before Missouri reinstates any driving privileges.

If it is your first conviction for drunk driving in Missouri, state law allows you to apply for an immediate 90-day Restricted Driving Privilege (RDP). The RDP, once approved, requires the installation of an ignition interlock device. The 90-day use of the RDP restricts driving to such locations as work, medical appointments, grocery stores, and religious services.

Another option for receiving an RDP is a 30-day suspension followed by a 60-day RDP. This RDP limits driving to the following:

  • Employment
  • Education
  • Alcohol treatment
  • Ignition interlock provider

An RDP differs from a Limited Driving Privilege (LDP). Sometimes referred to as a “hardship license,” the LDP applies to those whose license is suspended, revoked, or denied, or not eligible for reinstatement. For those with more than one DUI in Missouri conviction, they must install an ignition interlock device. In some cases, the court may require the device for only one conviction, depending upon the circumstances.

In order to receive an LDP, you must petition the court. If approved, the LDP allows you to operate a motor vehicle in certain pre-approved situations. Drivers with an active 5 or 10-year denial on their record must install an ignition interlock device with a camera. The court may require a GPS system in addition to the camera.

Another important requirement is SR 22 insurance coverage. This liability insurance is necessary for anyone seeking to get their license reinstated in Missouri and must meet the state’s minimum requirements. If the policy lapses, any temporary license privileges become revoked.
