Ignition Interlock Device Laws

  • New Hampshire ignition interlock device law requires interlock devices installed for any driver convicted of DUI, even first-time offenders, in order for the driver to qualify for reinstatement of driving privileges.
  • The period of time during which the interlock device must remain installed ranges from 12 months to two years at the discretion of the court.
  • The offender is responsible for all installation fees, maintenance fees, and any other costs associated with the installation and operation of the device.

License Suspension

Administrative Suspension

DUI laws in New Hampshire state that drivers who are stopped for suspicion of DUI face an automatic, immediate administrative license suspension if they refuse to take a field breath test at the time of arrest or if they register a BAC of .08% or higher on that test.

If the driver does not successfully challenge the suspension within 30 days, the suspension will remain in effect for 180 days.

Judicial Suspension

Drivers who are convicted in court of DUI face additional court-ordered license suspensions and penalties.
