Ignition Interlock Device Laws

  • Repeat DUI offenders may, at the discretion of the court, have their driving privileges reinstated if they agree to have an ignition interlock device installed in their vehicles.
  • The court also has the option of extending the period during which the driver must use an interlock device beyond the end of the license suspension.
  • The additional interlock period may be between six and 30 months according to Kentucky ignition interlock law

License Suspension

Kentucky DUI laws state that any driver with a BAC of .08% or above may be charged with DUI.

A driver may also be charged if he or she shows signs of impairment regardless of BAC.

A driver under the age of 21 may be charged with a BAC at or above .02.

Upon conviction for DUI, a driver is subject to a license suspension.

DUI Penalties and Fees in Kentucky

1st Offense Fine: $200 to $500
Jail Time: 2 to 30 days
Period of License Suspension: 30 to 120 days
2nd Offense Fine: $350 to $500
Jail Time: 7 days to 6 months
Period of License Suspension: 12 to 18 months
3rd Offense Fine: $500 to $1000
Jail Time: 30 days to 12 months
Period of License Suspension: 24 to 36 months
4th Offense Fine: At court’s discretion
Jail Time: 120 days minimum
Period of License Suspension: 60 months
Other Possible Penalties in Kentucky • A requirement that you attend a substance abuse program under the referral of the court. Time varies based on number of offense.
• A community labor requirement – also varies based on number of offense.
