Ignition Interlock Device Laws

  • Illinois ignition interlock device laws state that drivers with suspended licenses may apply for a Monitored Device Driving Permit (MDDP), which reinstates unlimited driving privileges provided that the driver installs an ignition interlock device on his or her vehicle.
  • A driver with a revoked license may not apply for an MDDP, but he or she may apply for a Restricted Driving Permit (RDP), which allows driving to and from work and other essential travel, usually with the condition that an interlock device be installed on any vehicle he or she drives.
  • If an offender drives without an interlock device during a period of license suspension, he or she is guilty of a felony and is subject to severe fines and jail time.

License Suspension

Administrative Suspension

If a driver fails or refuses a field breathalyzer test after being stopped for suspicion of DUI, the arresting officer will issue a notice of automatic license suspension.

If the driver does not challenge the suspension or if a challenge is denied, the suspension takes effect after a 45-day grace period from the date of the notice.

Judicial Suspension

If convicted of DUI by a court, a driver will face license revocation with no guarantee of reinstatement.

1st Offense (class A misdemeanor) Fine: Up to $2,500
Period of License Suspension: 1 year minimum
2nd Offense (class A misdemeanor) Fine: Up to $5,000
Jail Time: 5 days minimum
Period of License Suspension: 5 years minimum
3rd Offense (class 2 felony) Fine: Up to $25,000
Jail Time: 10 days minimum
Period of License Suspension: 10 years minimums
4th Offense (class 2 felony) Fine: Up to $25,000
Jail Time: 10 days minimum
Period of License Suspension: Life
